Why didn t my Navient loans get forgiven?
The Navient settlement does not provide for any student loan forgiveness or cancellation for federal student loans. However, federal student loan borrowers may be able to request forgiveness of their federal student loans through the Borrower Defense to Repayment program.
Navient loans can be forgiven after 20 years if they are federal student loans repaid under an IDR plan. The forgiveness applies to loans received for undergraduate study, while loans for graduate or professional study or Parent PLUS Loans may be forgiven after 25 years.
Incomplete Loan Data Could Result In Some Periods Not Counting Toward Student Debt Forgiveness. Another possible issue for some borrowers could be defective loan data. The Education Department relies on data submitted by loan servicers to a system called the National Student Loan Data System.

If you're notified that you're eligible for forgiveness, loan repayment will be paused until the discharge is processed, the Department of Education says. Your loan servicer should let you know when your student loan debt is discharged.
If you have FFELP Loans, there are several ways to become eligible for loan forgiveness. Most FFEL borrowers are eligible for the Income-Based Repayment (IBR) Plan, where you pay 10 or 15 percent of your discretionary income for 20 or 25 years before the remaining loan balance is forgiven.
Income-Based Repayment (IBR)—Depending on when you first took out loans (before or on or after July 1, 2014), payments are generally 10% or 15% of the borrower's discretionary income, but never more than the 10-year Standard repayment plan amount. The remaining unpaid balance of loans is forgiven after 20 or 25 years.
Many borrowers, largely those on IDR plans and in the Public Service Loan Forgiveness (PSLF) program, have received relief, but they represent only a small fraction of the 44.5 million Americans with student debt.
You may notice your former servicer has cleared your loan account. For example, your loan balance may come up as “paid in full” on your former servicer's website or on your credit report. This does not mean you've received loan forgiveness. This is part of the loan transfer process.
Who is eligible for Navient debt cancellation?
The settlement class includes borrowers with private student loans serviced by Navient who meet the following criteria: They filed for bankruptcy on or after October 17, 2005. Before they filed for bankruptcy, they were obligated to repay their loans. A court approved them for loan discharge via bankruptcy.
Navient's student loan portfolio is split between private student loans and commercially held loans from the Federal Family Education Loan Program (FFELP). The company holds $38 billion worth of FFELP loans and $17 billion worth of private education loans, a Navient representative said.
Navient is no longer servicing federal loans owned by the U.S. Department of Education. These loans were transferred to a new servicer, Aidvantage, in January 2022.
The PSLF Program forgives the remaining balance on your Direct Loans after you've made the equivalent of 120 qualifying monthly payments while working full time for a qualifying employer.
Borrowers who have reached 20 or 25 years (240 or 300 months) worth of payments for IDR forgiveness may see their loans forgiven in Spring 2023. ED will continue to discharge loans as borrowers reach the required number of months for forgiveness. All other borrowers will see their loan accounts updated in 2024.
Borrowers should expect that the process may take up to six months, and in some cases, longer.

Why are my Navient loans not paused? Your Navient loans aren't eligible for the federal student loan payment pause and 0% interest rate period because they are privately-held federal student loans or private student loans, neither of which are held by the U.S. Department of Education.

You're not eligible for federal student loan forgiveness programs if you have private loans, but there are other strategies for managing private loan debt.
