Can the government take your Social Security for student loans?
The short answer is yes. The government is allowed to garnish your Social Security benefits if you don't pay your student loans. But there are some limitations and other caveats to know.
If you default on your student loans, your wages can be garnished, your Social Security benefits can be reduced, and a range of other consequences can come into play. You can avoid losing out on federal benefits by getting back on track with student loan payments and staying up to date.
You'll be subject to garnishment of up to 50% of your Social Security benefits if you're supporting a spouse or child other than the one specified in the court order. If you aren't supporting another spouse or child, up to 60% of your after-tax income can be garnished.
Can my student loans be forgiven if I'm retired? Your student loans won't be automatically forgiven when you retire. However, it's possible that the length of your repayment period could qualify you for student loan forgiveness under some federal student loan plans.
Taking funds from your account typically only happens in situations such as a student loan being about to go into default when the person holding the loan has money sitting in checking that could cover the debt.
For starters, the government can garnish up to 15% of your Social Security payments if you default on your federal student loans. And the minimum it can leave you is $750 per month.
Unfortunately, American lawmakers haven't provided student loan borrowers with age-based forgiveness. Like millennials burdened with student debt, you're expected to keep paying your education loans until they're paid in full, forgiven, or you die.
You may hear that seniors shouldn't worry about old debts. This is partially, but not completely, true. Many seniors are “judgment proof,” which means their income is derived from retirement, Social Security, or other accounts that can't be garnished.
In general, the answer is no, creditors and debt collectors cannot seize your Social Security benefits.
At what age do student loans get written off? There is no specific age when students get their loans written off in the United States, but federal undergraduate loans are forgiven after 20 years, and federal graduate school loans are forgiven after 25 years.
Why would elderly people still have student loan debt?
Eventually, they age into one of the fastest growing subsets of student loan borrowers—adults approaching retirement age. Borrowers who still carry debt from their own education well into their senior years often attended low-value programs that did not provide enough support to help them reach graduation.
The number of people age 60 and older who still have student loan debt has sextupled since 2004 to 3.5 million, and the amount they owe is up 19-fold to $125 billion. Older Americans with student loan debt take second jobs, delay retirement, are less likely to own their own homes and suffer low credit scores.
As a result, student loans can't take your house if you make your payments on time. However, if you miss enough student loan payments, your accounts will first move into delinquency status and then into default status. Once you default on student loans, you're at risk of having your house taken to pay them back.
Note: As part of the Fresh Start Program, borrowers with eligible defaulted loans are receiving certain relief measures, including wages not being garnished. This relief will continue through at least September 2024.
Do student loans go away after 7 years? While negative information about your student loans may disappear from your credit reports after seven years, the student loans will remain on your credit reports — and in your life — until you pay them off.
Since it's a debt owed to the government, if you default on a federal student loan, a portion of your Social Security benefits can be automatically garnished to repay the loan.

What happens to student loans after 25 years?
Borrowers who have reached 20 or 25 years (240 or 300 months) worth of eligible payments for IDR forgiveness will see their loans forgiven as they reach these milestones. ED will continue to discharge loans as borrowers reach the required number of months for forgiveness.
You can't be arrested or put in jail for not repaying consumer debts like credit cards or medical bills. But you can be sued, which sometimes leads to arrest or jail time.
Bankruptcy. Sometimes, it's best to just eliminate debts altogether through bankruptcy. This can effectively erase credit card debt, medical bills, utility bills, and other types of debt. With Chapter 7 bankruptcy, one can liquidate assets to pay off debt, except for child support, alimony, and similar forms of debt.
Seniors who reside in an assisted living facility and run out of funds will be evicted. Elderly individuals who are unable to turn to family for financial support and have no money can become a ward of the state. This may be the case if the senior develops a health emergency and is no longer able to live alone.
Some sources of income are considered protected in account garnishment, including: Social Security, and other government benefits or payments. Funds received for child support or alimony (spousal support) Workers' compensation payments.
