Who gets student loans cancelled by Navient?
Borrowers who have made 20 or 25 years of qualifying payments (depending on the repayment plan) qualify, if they hold direct loans or Federal Family Education Loans with the Education Department, including borrowers with Parent PLUS loans.
The settlement class includes borrowers with private student loans serviced by Navient who meet the following criteria: They filed for bankruptcy on or after October 17, 2005. Before they filed for bankruptcy, they were obligated to repay their loans. A court approved them for loan discharge via bankruptcy.
Navient loans can be forgiven after 20 years if they are federal student loans repaid under an IDR plan. The forgiveness applies to loans received for undergraduate study, while loans for graduate or professional study or Parent PLUS Loans may be forgiven after 25 years.
Navient will notify eligible private loan borrowers of the discharge of their private loans in writing by July 2022. Consumers who are eligible for the private loan cancellation under the settlement do not need to take any action.
Navient was one of the largest federal student loan servicers prior to ending its contract after Dec. 31, 2021. Its loans were transferred to Aidvantage. Navient still services some FFELP loans and private student loans from various lenders.
Your loan must have been delinquent for at least seven months or charged off before June 30, 2021. You must live in a state participating in the settlement. More on that below.
The Navient settlement does not provide for any student loan forgiveness or cancellation for federal student loans. However, federal student loan borrowers may be able to request forgiveness of their federal student loans through the Borrower Defense to Repayment program.
If you're notified that you're eligible for forgiveness, loan repayment will be paused until the discharge is processed, the Department of Education says. Your loan servicer should let you know when your student loan debt is discharged.
If you have FFELP Loans, there are several ways to become eligible for loan forgiveness. Most FFEL borrowers are eligible for the Income-Based Repayment (IBR) Plan, where you pay 10 or 15 percent of your discretionary income for 20 or 25 years before the remaining loan balance is forgiven.
Pay less over the life of the loan: Because your student loan, like most other debt, accrues interest when you carry a balance, it's cheaper if you pay off the loan earlier. It gives the debt less time to accumulate interest, meaning you'll pay less in the long run.
Why did my Navient loans disappear?
Navient was one of the companies that serviced federal student loans by collecting and tracking payments. It stopped servicing federal direct student loans after Dec. 31, 2021. By that point, all federal loans in the Navient portfolio were transferred to another servicer called Aidvantage.

If you don't make your student loan payment or you make your payment late, your loan may eventually go into default. If you default on your student loan, that status will be reported to national credit reporting agencies.
Income-Based Repayment (IBR)—Depending on when you first took out loans (before or on or after July 1, 2014), payments are generally 10% or 15% of the borrower's discretionary income, but never more than the 10-year Standard repayment plan amount. The remaining unpaid balance of loans is forgiven after 20 or 25 years.
If you see one of your Navient loans listed there, it is a federal loan. Navient moved most of its federal student loan accounts to Aidvantage. But it still services FFEL Loans that don't qualify for the interest-free payment pause during the pandemic. Navient also services, refinances, and owns private student loans.
Navient can only settle private student loans, not federal loans. For this reason, it's important first to establish whether your loan is federal or private before discussing settlement.
You can identify your loan types by logging on to StudentAid.gov and selecting “My Aid” in the dropdown menu under your name. In the “Loan Breakdown” section, you'll see a list of each loan you received. You'll also see loans you paid off or consolidated into a new loan.
Unlike with federal student loans, forgiveness rarely applies to private student loans. Some lenders offer student loan forgiveness if you die or become permanently disabled, but not all do. In addition, you'll almost certainly still be on the hook for your private student loan if your cosigner dies.
Why are my Navient loans not paused? Your Navient loans aren't eligible for the federal student loan payment pause and 0% interest rate period because they are privately-held federal student loans or private student loans, neither of which are held by the U.S. Department of Education.
Forgiveness isn't an option for defaulted loans. You'll need to use consolidation or rehabilitation to get defaulted federal student loans in good standing before they're eligible for forgiveness programs.
