Paying off old debts before they reach the statute of limitations or credit reporting deadline can positively influence your payment history, a significant factor in your FICO score. This move can boost your credit score and contribute to a healthier credit profile.
Paying off collection accounts could improve your credit scores, but there's no guarantee since you can't know which credit scoring model a lender will use to process your credit application.
If you can afford to pay off a debt, it is generally a much better solution than settling because your credit score will improve, not decline.
Generally, if you have the funds to pay off a debt they're really aren't many drawbacks to doing so. It certainly won't hurt your credit to pay off an old debt, and while it may "revive" the debt that really doesn't matter once the debt's paid off (just make sure you keep adequate records of everything).
Highlights: Most negative information generally stays on credit reports for 7 years. Bankruptcy stays on your Equifax credit report for 7 to 10 years, depending on the bankruptcy type. Closed accounts paid as agreed stay on your Equifax credit report for up to 10 years.
Your credit score may not increase at all when you pay off collections. However, if your debt is reported using a newer credit scoring model, your score may increase by however many points were impacted by the collections debt. It would also depend on the time passed since getting the negative mark.
Paying an old collection will likely lower your score. After about two years, the scoring impact is minimal, assuming the creditor has not been attempting continually to collect. If you pay them off now, the status will change to “Paid Collection” (still bad)—with a current date.
However, if there's still a lot of time left for creditors or collectors to sue, it may be wise to start making payments. Having said that, an unpaid debt will stay on your credit report for about seven years, even if the time clock has run out.
Debt Settlement Impact on Credit Score
While not as devastating as a bankruptcy, debt settlement will have a negative impact on your credit score if you work directly with your creditors, as the settlement may be reported by the creditor to each of the three leading credit bureaus.
It can take weeks or even days for you to notice a change in your credit score. If you have recently paid off a debt, wait for at least 30 to 45 days to see your credit score go up. Can a 10 year old debt still be collected?
In most states, debt collectors can still attempt to collect debts after the statute of limitations expires. They can try to get you to pay the debt by sending you letters or calling you as long as they do not violate the law when doing so. They can't sue or threaten to sue you if the statute of limitations has passed.
The Legal Side: Statutes of Limitations
This time period ranges from 3-6 years usually. According to the CFPB, once the statute of limitations expires, a collector legally can't sue you for the debt. That doesn't mean you don't technically still owe the money though. The debt doesn't just vanish or become invalid.
The best way is to pay
Most people would probably agree that paying off the old debt is the honorable and ethical thing to do. Plus, a past-due debt could come back to bite you even if the statute of limitations runs out and you no longer technically owe the bill.
Specifically, section 609 of the FCRA gives you the authority to request detailed information about items on your credit report. If the credit reporting agencies can't substantiate a claim on your credit report, they must remove it or correct it.
You cannot remove collections from your credit report without paying if the information is accurate, but a collection account will fall off your credit report after 7 years whether you pay the balance or not.
If you don't pay, the collection agency can sue you to try to collect the debt. If successful, the court may grant them the authority to garnish your wages or bank account or place a lien on your property. You can defend yourself in a debt collection lawsuit or file bankruptcy to stop collection actions.
Yes, it's possible to achieve a higher credit score even with collections on your report, but it's more challenging. The impact of collections on your credit score diminishes over time, especially if you maintain good credit habits like making payments on time and keeping your credit utilization low.
